Cancellation Policy

Code24x7 Private Limited ('Code24x7') is a private limited company registered in India under the Companies Act, 2013. This Cancellation Policy outlines the terms and conditions for canceling our services, applicable fees, and the refund process. This Policy applies to all services provided by Code24x7 Private Limited, including web development, mobile app development, software development, and related IT services. Please read this Policy carefully before engaging with our services.

Introduction

This Cancellation Policy ('Policy') applies to all services provided by Code24x7 Private Limited ('we', 'us', 'our', or 'Company'), a private limited company registered in India under the Companies Act, 2013.

This Policy outlines the terms and conditions under which you may cancel services, the applicable fees and charges, and the refund process. This Policy should be read in conjunction with our Terms and Conditions and Service Agreements.

By engaging our services, you agree to be bound by this Cancellation Policy. We reserve the right to modify this Policy at any time, and changes will be effective upon posting on our website.

Your Cancellation Rights

You have the right to cancel services subject to the terms outlined in this Policy and your specific Service Agreement. Cancellation rights vary based on the type of service:

  • Subscription Services: You may cancel subscription services at any time with written notice
  • Project-Based Services: You may cancel project-based services as per the terms of your Service Agreement
  • One-Time Services: Cancellation of one-time services may be subject to completion status
  • Recurring Services: Recurring services may be cancelled with notice as specified in your agreement

How to Cancel Services

To cancel any service, you must provide written notice of cancellation through one of the following methods:

  • Email: Send a cancellation request to info@code24x7.com from your registered email address
  • Written Notice: Send a written cancellation request to our registered office address
  • Phone: Call us at +91-9576660086 and follow up with written confirmation
  • Through Your Account: If available, cancel through your online account portal

Required Cancellation Information

Your cancellation request must include:

  • Your full name and contact information
  • Service account number or reference ID
  • Reason for cancellation (optional but helpful)
  • Requested effective date of cancellation
  • Your signature (for written requests)

Cancellation Fees and Charges

Cancellation fees may apply depending on the type of service, timing of cancellation, and work completed. Our fee structure is as follows:

  • Subscription Services (Monthly/Annual):
  • • Cancellation within first 7 days: Full refund minus processing fees (if applicable)
  • • Cancellation after 7 days but before next billing cycle: No cancellation fee, services continue until end of paid period
  • • Annual subscriptions cancelled mid-term: Pro-rated refund for unused months, subject to 10% administrative fee
  • Custom Development Projects:
  • • Cancellation within 48 hours of project initiation: 90% refund (10% retention fee)
  • • Cancellation after 48 hours but before 25% completion: 70% refund, 30% retention for work completed
  • • Cancellation between 25-50% completion: 50% refund, 50% retention for work completed
  • • Cancellation after 50% completion: No refund, full payment due for all work completed
  • Maintenance and Support Services:
  • • Monthly maintenance: Cancellation takes effect at end of current billing period, no cancellation fee
  • • Annual maintenance: Pro-rated refund for unused months minus 15% administrative fee
  • Consulting Services:
  • • Cancellation 48+ hours before scheduled session: Full refund
  • • Cancellation 24-48 hours before session: 50% refund
  • • Cancellation less than 24 hours: No refund

Cancellation Effective Date

The effective date of cancellation depends on the type of service:

  • Subscription Services: Cancellation takes effect at the end of the current billing cycle. You will continue to have access to services until the end of the paid period
  • Project-Based Services: Effective immediately upon acceptance of cancellation, unless otherwise specified in your Service Agreement
  • Recurring Services: Effective at the end of the current service period or as specified in your agreement
  • One-Time Services: Effective immediately, subject to payment for work completed

Cancellation Confirmation

We will confirm your cancellation and effective date in writing within 5 business days of receiving your cancellation request.

Refund Processing

If you are eligible for a refund based on this Policy and your Service Agreement:

  • Refund Timeline: Refunds are processed within 10-15 business days from the date of cancellation confirmation
  • Payment Method: Refunds will be issued to the original payment method used for the transaction
  • Bank Transfers: For bank transfers, refunds may take 5-10 additional business days
  • Processing Fees: Some payment methods may incur processing fees that cannot be refunded
  • Currency: All refunds will be processed in Indian Rupees (INR) at the exchange rate applicable at the time of refund

Refund Confirmation

You will receive email confirmation once your refund has been processed. If you do not receive your refund within the stated timeframe, please contact us immediately.

Work Product and Deliverables

Upon cancellation:

  • Completed Work: You will receive all work product and deliverables completed up to the cancellation date
  • Source Code and Files: We will provide source code, files, and documentation for completed work as specified in your Service Agreement
  • Licenses: Any licenses granted for completed work will remain in effect
  • Support: Post-cancellation support for delivered work may be available under separate agreement

Data Retention and Deletion

Upon cancellation:

  • Data Retention Period: Your data will be retained for 90 days from the cancellation date for backup and recovery purposes
  • Data Export: You may request export of your data within 30 days of cancellation
  • Data Deletion: After 90 days, data will be permanently deleted and cannot be recovered
  • Third-Party Data: We are not responsible for data held by third-party service providers

Special Circumstances

We understand that special circumstances may require cancellation. In such cases, we may consider:

  • Medical Emergencies: Documentation required, case-by-case consideration
  • Business Closure: Documentation required, may waive cancellation fees
  • Service Quality Issues: If cancellation is due to our failure to meet service standards, we will provide appropriate refunds
  • Force Majeure: Cancellation due to circumstances beyond your control may be considered for fee waiver

Our Right to Cancel

  • Non-Payment: If payment is overdue beyond the grace period specified in your agreement

  • Illegal Activities: If services are used for illegal purposes
  • Misrepresentation: If you provide false or misleading information
  • Business Reasons: For legitimate business reasons, with 30 days written notice (excluding non-payment and violations)

Refunds for Our Cancellations

If we cancel services due to non-payment or violation of terms, no refund will be provided. If we cancel for other business reasons, you will receive a pro-rated refund for unused services.

Disputes and Grievances

If you disagree with any cancellation fees or refund decisions:

  • Written Complaint: Submit a written complaint detailing your grievance
  • Review Process: We will review your complaint and respond within 10 business days
